Terms and Conditions
THIRD COAST NAVIGATION
TERMS AND CONDITIONS
Effective date: September 29, 2026
These Terms and Conditions (“Terms”) govern your access to and use of the Third Coast Navigation application, website, charts, waypoints, course plots, fuel and time estimates, weather information, downloadable routes, and all related services (together, the “Application”). The Application is offered by Third Coast Navigation, its creator, owners, officers, employees, contractors, and affiliates (together, “Third Coast Navigation,” “we,” “us,” or “our”).
By creating an account, paying for a subscription, downloading a route, or otherwise using the Application, you agree to these Terms. If you do not agree, do not use the Application.
1. The Application is a planning aid only
The Application helps you plan a trip. It is not a certified nautical chart, a navigation system, an autopilot, a substitute for your vessel’s GPS or onboard electronics, or a substitute for your judgment as captain.
Distances, bearings, courses, return tracks, fuel burn, gallons required, and underway time are estimates. They depend on information you enter, including speed and gallons per hour, and on data that may be incomplete, outdated, or wrong. A route downloaded to your GPS must be checked by you before you get underway. You are solely responsible for the vessel, the people aboard, and every decision made while using the Application.
2. You must obey maritime law
You agree to obey all applicable maritime, navigation, and boating laws and regulations, including the International Regulations for Preventing Collisions at Sea (COLREGS), the U.S. Inland Navigation Rules where they apply, Coast Guard rules, and state and local law.
You will keep a proper lookout, proceed at a safe speed, follow required lights and sound signals, and carry the safety equipment the law requires. Nothing in the Application gives you permission to enter restricted waters, ignore aids to navigation, or operate a vessel without the license, training, or authority the law requires.
3. You must watch the weather
You agree to check current and forecast marine weather, seas, tides, currents, and warnings from official sources before you leave the dock and while you are underway. Any weather information shown in the Application is a convenience only. It may be delayed, incomplete, or inaccurate. It is not a substitute for National Weather Service marine forecasts, Coast Guard broadcasts, or conditions you can see from the boat. If the weather is unsafe, do not go.
4. Assumption of risk
Boating and offshore fishing are dangerous. Risks include collision, grounding, capsizing, flooding, fire, mechanical failure, fuel exhaustion, person overboard, drowning, injury, and death. Those risks exist whether or not you use the Application. You knowingly assume all risk of using the Application and of operating a vessel after using it.
5. No liability
To the fullest extent permitted by law, Third Coast Navigation, its creator, and its affiliates are not liable for any action you take, or fail to take, while using the Application or afterward, including any action on the water.
Without limiting that statement, Third Coast Navigation, its creator, and its affiliates are not liable for:
-
boating accidents, including accidents that cause injury or death to you, your passengers, your crew, or anyone else;
-
damage to, or loss of, any vessel, tender, engine, gear, or property used with or in connection with the Application;
-
grounding, collision, allision, sinking, or stranding;
-
fuel estimates that are wrong, fuel that runs out, or a course that is longer or shorter than shown;
-
a waypoint, route, depth, or position that is missing, misplaced, or wrong;
-
weather information that is late, missing, or wrong, or a decision to depart or remain underway;
-
a route transferred to a GPS or other device;
-
loss of income, charters, catch, or use of the vessel.
This release covers claims of every kind, whether based on contract, warranty, negligence, strict liability, or any other theory, and whether the harm was foreseeable. If a claim cannot legally be released, liability is limited to the amount you paid Third Coast Navigation for the Application in the twelve months before the claim, or one hundred U.S. dollars, whichever is greater.
Some states do not allow certain limitations. In those states, our liability is limited to the maximum extent the law allows. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that the law does not allow to be limited.
6. Your responsibility to others
If you carry passengers, clients, or crew, you are solely responsible for their safety and for what you tell them about the trip. Third Coast Navigation has no relationship with your customers and does not insure them or your vessel.
7. Indemnity
You will defend, indemnify, and hold harmless Third Coast Navigation, its creator, and its affiliates from any claim, loss, damage, fine, or expense, including reasonable attorneys’ fees, arising out of your use of the Application, your operation of a vessel, your violation of these Terms, or your violation of maritime or other law. This includes claims by passengers, clients, crew, and other boaters.
8. No warranty
The Application is provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Application will be uninterrupted, that a route is safe, or that any estimate will match real conditions.
9. Subscription
Paid access is billed in advance at the price shown at checkout and continues until you cancel. Canceling stops future charges. It does not entitle you to a refund of time already paid except where the law requires a refund. We may suspend access if a payment fails.
10. Changes and contact
We may update these Terms by posting a new version. If you keep using the Application after the new effective date, you accept the updated Terms. Questions about these Terms may be sent through the contact method published on the Third Coast Navigation website.
11. Governing law
These Terms are governed by the laws of the State of Texas, except where federal maritime law applies, and without regard to conflict-of-law rules. You agree that the state and federal courts located in the State of Texas have exclusive jurisdiction, except where maritime law requires a different forum.
12. Entire agreement
These Terms are the entire agreement between you and Third Coast Navigation about the subject of this document. If a court holds one part unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver.
By using the Application, you acknowledge that you have read these Terms, that you understand that boating can result in injury or death and in damage to your vessel, and that Third Coast Navigation, its creator, and its affiliates are not liable for any action you perform while using the Application.
